$10.5 million settlement (including interest) for construction accident following $8.9 million verdict (reduced to $7.6 million on appeal) for a 31-year old electrician who was kneeling on wooden platform of Baker’s scaffold that collapsed, and he fell 8 feet to the concrete floor below, with resulting comminuted fracture of his kneecap (patella) and tear of lateral meniscus. Our client required surgery with open reduction and internal fixation, a second operation to remove the hardware and for partial lateral meniscectomy, and a third operation for further partial lateral meniscectomy.
$7.5 million settlement pursuant to high-low agreement (after jury verdict for $15.3 million) for catastrophic injuries in construction accident for 42-year old steamfitter who fell from ladder due to extreme heat conditions which caused him to become woozy, with resulting comminuted fracture of the left humerus, two broken ribs, nondisplaced fractures of the pelvis, and head trauma resulting in post-traumatic epilepsy and psychiatric problems from organic brain syndrome and diffuse axonal injury. Jury verdict in excess of $4 million for construction accident which resulted in $3.25 million settlement pursuant to “high/low” agreement, for 58-year old electrician who received electric shock while working on ladder, causing him to fall 20 feet and suffer fracture/dislocation of right ankle, with fracture of fibula and severely comminuted fracture of the tibial pilon, which required several surgical procedures.
