Arye, Lustig & Sassower, P.C., Starts Legal Proceedings After Fatal Construction Accident

The widow of a construction worker who was killed when a wall collapsed as part of a project to modernize New York City’s water supply system has filed a Notice of Claim for $40 million against New York City and the NYC Department of Environmental Protection. The widow, Doreen Winkler, is represented by D. Carl Lustig III, Esq., of the Manhattan personal injury firm Arye, Lustig & Sassower, P.C.

The fatal accident occurred on Dec. 2, 2013, in Maybrook, New York, on the property of Halmar International Inc., one of the prime contractors for the Catskill Aqueduct construction project, which is being constructed for the City of New York under the authority of the New York City Department of Environmental Conservation.

A concrete wall was being poured to create a mock-up for the Catskill Aqueduct when the wall collapsed. Scott Winkler was severely injured when the concrete wall collapsed and he died from his injuries on Dec. 10. He was employed by a subcontractor, Precision Concrete Pumping, Inc., of Albany, N.Y.

Mr. Winkler is survived by his wife, Doreen Winkler, and their five children. Another employee of Precision Concrete Pumping, Timothy Lang, of Saugerties, New York, was killed in the same accident.

A Notice of Claim is the first step to begin legal proceedings in a personal injury lawsuit against the City of New York and its subsidiary agencies and departments.
