Unsafe Scaffolds Cause Accidents
According to the Bureau of Labor Statistics, 72 percent of workers who were injured on scaffolds said that the planking or support gave way or the workers slipped or were struck by an object. OSHA says that complying with standards could avoid many scaffold accidents.
Unfortunately, not every scaffold is properly constructed. Contractors who build scaffolds may take shortcuts or may neglect to install required safety features such as guardrails. When workers have to use those scaffolds, catastrophic injuries can result.
Under New York Law, You Can Recover Damages
The law in New York imposes a nondelegable duty on owners of job sites, contractors and their agents to make sure that proper protection is provided for workers who are using scaffolds. This allows workers (and their families) who are injured due to inadequate scaffolds to recover money damages for their injuries and resulting lost earnings and medical expenses.
